Background Papers

The ICSID Secretariat issues consultation and background papers from time to time. These include:

Consultation Papers on 2006 Rules Amendment: The current rules came into effect on April 10, 2006, following a two-year period of extensive public consultation. As background, the Secretariat issued a discussion paper on October 22, 2004 titled Possible Improvements of the Framework of ICSID Arbitration and a working paper on May 12, 2005 titled Suggested Changes to the ICSID Rules and Regulations.

Background Report on Annulment: On May 5, 2016, the ICSID Secretariat provided ICSID Member States with a Report concerning the ICSID Convention annulment mechanism. The Report is an updated version of the Background Paper on Annulment provided to Member States in 2012. It provides an overview of the annulment remedy and empirical data on annulment to April 15, 2016. The Report is not intended as legal advice, nor does it take a position on whether any case is correctly decided.
